  What Is e-Filing
E-filing is a new service provided by the Intellectual Property Office, India in order to enable customers to apply for a patent on-line allowing from the User’s browser for the User to:
• Complete an electronic application form
• Provide the associated attachments
• Complete the necessary payment details
 
 
  What is Certifying Authority
The Information Technology (IT) Act, 2000 provides for use of Digital Signatures on the documents submitted in electronic form in order to ensure the security and authenticity of the documents filed. Certification Agencies are appointed by the office of the Controller of Certification Agencies (CCA) under the provisions of IT Act.

The Controller General of Patents, Designs and Trade Marks (CGPDTM) has
stipulated a Class-III category certificate for e-Filing of Patent and Trade Marks applications in India.

The e-Filing systems for Patents and Trade Marks are designed to support Class
III Digital Signature Certificates (DSCs). You may obtain your Class III DSC from

What is the benefit of e-Filing?
If you file your Trade Mark application on-line, you will:  
Receive a Patent application number immediately
On-line verification to assure error-free filing and obtain your filing date
Speed up the registration process
Print the completed application data and receive fee acknowledgement
Save the data locally in your PC
Be able to recall your contact details for subsequent applications
How Do I do it?
In order to submit an electronic patent application form, following steps are needed:
Acquire Class 3 Digital Signatures from (n)Code Solutions.
New users (Applicants, Agents or Attorneys), can complete online registration by providing Digital Signature details to get a User ID and Password for using the e-Filing System of Indian Patent Office (IPO).
Secure Login into the system with created User Id and the Password.
Download the Client Software for preparing Patent Application Offline with required documents and Digitally Sign it for uploading on IPO Server.
Fill Patent Application offline and generate an XML file using Client Software.
After creating application(XML) file offline, Digitally Sign the XML file(Max. file size permitted 5MB) for uploading on to the IPO Server.
Login into e-Patent portal for uploading Application XML file on IPO Server.
Upload & Submit Digitally Signed XML file to IPO Server.
Process Application for EFT (Electronic Fund Transfer) using State Bank of India(SBI) Payment Gateway.
Review Application Status on e-Patent Portal.
On successful EFT acknowledgement details would be displayed/ generated.
Print Acknowledgement. Click on "Print" to generate printout of acknowledgement.

If you file your Trade Mark application on-line, you will:  
Receive a trade mark application number immediately
On-line verification to assure error-free filing and obtain your filing date
Speed up the registration process
Print the completed application data and receive fee acknowledgement
Save the data locally in your PC
Be able to recall your contact details for subsequent applications
 
How Do I do it?
In order to submit an electronic application form, following steps are needed:
Acquire Class 3 Digital Signatures from (n)Code Solutions.
For users (Proprietors/Agents or Attorneys), already registered with TMR Office India can complete online registration by providing a desired User ID, their User Type (Proprietor/Agent/Attorney) and User Code.
For Users who are not registered as Proprietor/Agent/Attorney with TMR Office, India can send an email to TMR Office, India at tmr-helpdesk@nic.in requesting for registration and providing a User Code for the desired user type (Proprietor/ Agent/ Attorney)
Secure Login into the system with created User Id and the Digital Signatures.
Obtain a New Reference Number for New Application.
Use this option when the applicant wants to apply for a new Trade Marks Application.
Update Application Details : Use this option to edit / update the application details along with relevant images and attached documents. Final Submission to TMR. India with Digital Signature is included in this option after which application can not be edited.
The Cases which are Digitally Submitted to TMR, India are available for online payment. The applicant can pay for more than one application in a single transaction. Once the payment is realized as confirmed by the Payment Gateway, an acknowledgement receipt for the fees paid is generated by the system indicating the Receipt Number, Application Number and Date of Filing.
8. An applicant can also view online History and status of the applications filed by him / her by clicking Status of Filed Application.
